EBay took its contention that injunctions demanded in patent lawsuits shouldn’t be granted automatically all the way to the U.S. Supreme Court and won. In a unanimous decision, the justices ruled that a judge in U.S. District Court did not have to grant an injunction asked for by MercExchange LLC as part of a patent dispute over the “Buy It Now” feature. But the court also said the judge didn’t apply a four-part test accurately and sent the case back to a lower court for review. The win is a technical KO as patent holders’ rights still stand.
