For example, a film which parodied, say, boxing couldn&#039;t use as its soundtrack a popular song and avoid paying for it because &quot;it&#039;s a parody&quot;. To have a parody defence you need to demonstrate that the copyright work you&#039;re using forms a major part of the parody itself - that it&#039;s the work you&#039;re seeking (at least in part) to parody. 

In other words, if the films seeks to parody the tattoo and its a significant plot device in the film, they might have a defence. If it&#039;s just a one-shot visual joke, which is what the judge appears to be saying, then it won&#039;t be covered. 

(Incidentally, I love the way you seem to think that the judge is unaware of the limits to the defence of parody. Just sayin...)]]></description>

Secondly it is a tribal design and though that are not all alike they are all similar.  The first commercial tattoo artist to do a tribal tattoo could show harm because others copied his design. 

The problem I have with this is if this lawsuit goes through then that means every person that has a tattoo of the nike swoosh, mickey mouse, mighty mouse, tinkerbell, USC, UCLA etc. etc. and any of the many other copyrighted designs that are tattoos will be open to the same lawsuit.  

 The big point to make is that these images were copyrighted before the tattoo artist tattooed them.  A law could possibly be created to bar them from tattooing these images. Think of all the pro athletes with these  types of tattoos; Disney and all these other large companies will be lined up around the block to file lawsuits.  ]]></description>
