Apple’s only defense is that their license extends to the developers, which may in fact not be true. If an independent developer lost the suit the payment damages would be huge which is why they had no option but to settle (Richard Shinderman, Michael Karr, etc.). The corporations that can afford it are the ones that need to stay in. He made the right decision.
