BharatMatrimony.com Fined By Consumer Court For Failing To Deliver
Ok, online consumer businesses are not insulated from consumer redressal courts. BharatMatrimony.com has been fined for failing to find suitable matches for one of its customers. A Delhi consumer forum has directed BM to pay Rs 15,000 as compensation for failing to provide a list of suitable profiles to a consumer as per the contract. The customer in question is a Delhi doctor who had registered at BM for finding suitable matches for his son and daughter. The portal refunded the registration fee in the case of daughter since they failed to get any reponse. But in the case of son, the portal refused to refund saying the the father had contacted some families through their website. The matter reached the consumer court, who fined the portal. BharatMatrimony.com os almost waste of time. I like shaadi.com since they are very keen on what they are doing. Not like BharatMatrimony.com jumping on all possible things…not a focussed company at all.
I think the judges never have heard th concept of goods that are once sold are not refunded under any cause.,
It applies to all goods., and services., That member should have used the free services that these matrimonial sites provide before continuing for paid registrations.
If he had paid, it means he was satisfied with these services, and its a wrong decision from the consumer court.
I dont agree with the judgement. Internet is a platform like newspaper where we give classfieds for Matrimonial or real estate. If you post an ad in newspaper for matrimonial classifieds and do not get appropriate match you cannot blame the medium for that. Similarly the website cannot be blamed for not finding a suitable match. Its purely based on the criteria that you have.
I feel the judgement is totally wrong. I personally feel the details should be properly verified and analyzed before any judgement of this sort is given. What if somebody puts a case that I registered in a job site did not get a job hence want a refund. If he has posted his entry with an extraordinary criteria he is not going to get it at all. Be it job or matrimonial or any online service for that matter, its purely the criteria of the person that matters. I can tell you lots of people who got married thru BharatMatrimony.com. Some of them are my close friends.
There are lots of cases pending still in variuos high and supreme court… person who has filed the case is no more but the case still goes on… this is the scene in our country today. Inspite of using the service and knowing about the service, these kind of cases are really waste and a judje for these kind of cases are also waste. The best part is the peron who has filed the case belongs to a servicing category :)
Know about the product or the service before you actually get in to it.
This is ridiculous. The person involved is a doctor. Tomorrow if he is treating somebody and if the other person files a case saying the treatment is of no use, will he accept? What will the judge do at that time. He will just give a judgment saying its a mistake not providing proper service without even analyzing the situation and the severity of illness? I think for these scenarios its better somebody with domain knowledge who is required to offer a judgment. MY question is did the judge go thru the service details fully before getting into it? I am sure he would not. A person knowing only law and no domain knowledge is of no use for these cases. Its high time this concern gets addressed. Otherwise we will end up in such wrong and useless judgements only.
I totally agree with chitra's view. No goods or services will be refunded after using it.And more over getting suitable matches within a short span depends on how boarder your needs are.
Really want to know to how many refunds that doctor had given in his services.:)
internet is a two way medium. even if the member does not get any response for his profile, he/she can always browse thru other profiles and contact him/her if interested.
so, i dont understant how one can say, the company has not rendered its service. why dint the doctor go online and search for suitable profile when there are plenty of them available?
Does Bharatmatrimony guarantee the no of responses against an ad? I am curious why in one case they returned the registration fee if they are not guranting any min no of responses.
The judgement overall doesn't hold much water.

Why doesn't the doc understand that the portal in no means is responsible for his son or daughter not getting a response? Bharat matrimony is only a platform thru which can tell the whole world that you are available for marriage. Maybe one should make his or her profile look attractive for people to take a look at. The doc has been very clever to have sued the portal and taken it for a ride. Is it actually believable that even after becoming a paid member they have not received any responses? My sister put up her profile as a non member in Bharat Matrimony and still so many people came across her profile and responded. I think a picture of a vampire or a bull dog must have been put up in the photo column…..else this wouldn't have been possible at all!!!!!
